1. Application適用

These terms apply to the use of Watercolor Posy (the “Service”). By using the Service, you are deemed to have agreed to these terms.

Watercolor Posy（以下「本サービス」）の利用に適用します。利用した時点で同意したものとみなします。

2. Rights in works and materials作品と素材の権利

Copyright in the original watercolour paintings and materials (flowers, buds, leaves, and the like) belongs to the artist mavon. You may freely use cards you make within these terms, but rights in the materials themselves are not transferred.

水彩の原画・素材（花・つぼみ・葉など）の著作権は作者 mavon に帰属します。お客様が作ったカードは規約の範囲で自由に使えますが、中の素材そのものの権利は移転しません。

3. Free use無料での利用

Free use is limited to personal, non-commercial purposes (for example cards for yourself or as gifts, and posting on a personal social-media account). Crediting mavon is recommended.

個人的・非商用の目的に限ります（自分用や贈り物のカード、個人のSNSへの掲載。mavon のクレジット表記を推奨します）。

4. Commercial use商用利用

Commercial use is not included in the current free public preview. If you contact us about a particular use, the inquiry itself does not grant permission. Any permitted commercial use and its conditions must be confirmed separately in writing. See Use & licensing.

現在の無料公開プレビューに商用利用は含まれません。個別の用途についてお問い合わせいただいた場合も、お問い合わせだけで利用許諾になるものではありません。許可する商用利用とその条件は、別途書面で確認します。詳しくは利用についてをご覧ください。

5. Prohibited acts禁止事項

You must not: redistribute, resell, or transfer the materials themselves; extract materials and sell or distribute them as templates or material packs; use them as training data for AI or machine learning, except where separately agreed in writing with the artist; use them in logos or trademarks; interfere with the operation of the Service; violate laws or public order and morals; or infringe the rights of others.

素材そのものの再配布・再販売・譲渡／素材を取り出してテンプレートや素材集として販売・配布すること／AI・機械学習の学習データへの利用（作者と別途書面で合意した場合を除きます）／ロゴ・商標への利用／本サービスの運営を妨げる行為／法令・公序良俗に反する行為／他者の権利を侵害する行為を禁じます。

6. Public preview公開プレビュー

This is an early version under development. Features, materials and supported environments may change. We may correct problems or remove content when needed. Please keep your own copies of important work.

本サービスは開発中の初期版です。機能・素材・対応環境は変更する場合があります。不具合の修正や、必要に応じた内容の削除を行うことがあります。大切な作品はご自身でも保存してください。

7. Saved data保存データ

Works are stored only in your browser and in files you save. Works lost because browser data was cleared or a device failed cannot be restored. Please save important works as files.

作品はお客様のブラウザと保存ファイルにだけ保存されます。ブラウザのデータ消去や端末の故障で失われた作品は復元できないので、大切な作品はファイルに保存してください。

8. Changes and suspension変更・停止

We may change or suspend the Service. Where practical, important changes will be announced on the site.

本サービスの内容を変更・停止することがあります。重要な変更は、可能な範囲でサイト上でお知らせします。

9. Disclaimer免責

Except in cases of our willful misconduct or gross negligence, we are not liable for damages arising from use of the Service. Where liability is limited by laws such as the Consumer Contract Act, we follow those limits.

当方の故意または重過失による場合を除き、本サービスの利用で生じた損害について責任を負いません。消費者契約法などの法令で制限される場合はその範囲に従います。

10. Changes to these terms規約の変更

We may change these terms after announcing the change on this page.

このページで告知のうえ変更できます。

11. Governing law and jurisdiction準拠法・管轄

These terms are governed by the laws of Japan. The district court with jurisdiction over our address shall be the exclusive court of first instance for any dispute.

日本法に準拠します。紛争は当方の住所地を管轄する地方裁判所を第一審の専属的合意管轄裁判所とします。
